Welcome to Emberhaus. These Terms & Conditions (the “Terms”) govern your access to and use of the website at this domain (the “Site”) and any purchase of products from us. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1Agreement to terms
These Terms form a legally binding agreement between you and Emberhaus Limited. Please read them together with our Privacy Policy, Shipping Policy and Return & Refund Policy, each of which is incorporated into these Terms by reference. We recommend you save or print a copy for your records.
2Who we are
The Site is operated by Emberhaus Limited (“Emberhaus”, “we”, “us” or “our”), a company incorporated in the Hong Kong Special Administrative Region of the People’s Republic of China. You can reach us at any time at emberhaus@gmail.com.
3Eligibility & accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.
You may choose to create an account to speed up checkout and track orders. You are responsible for keeping your login details confidential and for all activity that occurs under your account. Notify us promptly at emberhaus@gmail.com if you suspect any unauthorised use.
4Orders & acceptance
When you place an order, you are making an offer to purchase the selected products subject to these Terms. We will send an order-confirmation email acknowledging that we have received your order. This acknowledgement does not constitute acceptance.
A binding contract is formed only when we dispatch the products and send a shipping-confirmation email. We may decline or cancel an order, in whole or in part, at our discretion, for example, where a product is out of stock, where there has been a pricing or description error, where we suspect fraud, or where we are unable to obtain payment authorisation. If we cancel an order you have already paid for, we will refund you in full.
5Pricing & payment
- All prices are listed in United States Dollars (USD) unless stated otherwise, and are exclusive of any import duties or taxes that may apply on delivery.
- We may change prices, promotions and product availability at any time before you place an order. Changes will not affect orders we have already accepted.
- While we take care to price and describe products accurately, errors can occur. If we discover an error in the price of products you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel; if we cannot reach you, we may treat the order as cancelled and refund you.
- Payment is taken at checkout through our third-party payment processors. You must be authorised to use the payment method provided. By submitting payment details you confirm the details are valid and correct.
6Shipping & delivery
Delivery timescales, shipping charges, customs duties and related terms are set out in our Shipping Policy. Risk of loss and title to the products pass to you upon delivery to the address you provide. Please ensure your delivery details are accurate; we are not responsible for delays or non-delivery caused by incorrect address information.
7Returns & refunds
Your rights to return products and receive refunds or exchanges are described in our Return & Refund Policy. Because some of our products are scented and hand-poured, certain returns restrictions apply, as explained in that policy.
8Product information & safe use
We describe our products as accurately as we can, but colours, finishes, burn times and scent strength may vary slightly from batch to batch and from what appears on your screen. Always read the safety and care instructions printed on the packaging before use.
9Intellectual property
All content on the Site, including the Emberhaus name and logo, text, graphics, photography, product designs, and the arrangement of the Site, is owned by or licensed to Emberhaus Limited and is protected by intellectual-property laws. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, sell or exploit any part of the Site without our prior written permission.
10Acceptable use
You agree not to use the Site in any way that is unlawful or that could damage, disable or impair it. In particular, you must not attempt to gain unauthorised access to our systems, introduce malicious code, scrape or harvest data, misrepresent your identity, or use the Site to infringe the rights of others.

The Site may contain links to third-party websites or services that we do not control. We provide these links for convenience only and are not responsible for the content, products or practices of any third party. Accessing third-party sites is at your own risk and subject to their terms.
12Disclaimers

To the fullest extent permitted by law, Emberhaus Limited will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Site or our products. Where we are found liable, our total aggregate liability will not exceed the amount you paid for the products giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Emberhaus Limited and its directors, officers and employees from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

Our handling of your personal data is described in our Privacy Policy. By using the Site you acknowledge that we may process your information as set out in that policy.
16Changes to these terms
We may update these Terms from time to time to reflect changes in our business or the law. The “Last updated” date at the top shows when the latest version took effect. Changes apply to orders placed after the updated Terms are posted; the version in force at the time of your order governs that order.
17Governing law & jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region. You and Emberhaus Limited submit to the non-exclusive jurisdiction of the courts of Hong Kong, without prejudice to any mandatory consumer rights available to you in your country of residence.
18General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce a right is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Site.
